2024 Capital Improvements / Replacements (CI / CR): The board will be meeting with ELS on 9/24/2024, as it does the 4th Tuesday of each month, to focus primarily on the requested CI / CR or "pass throughs" which come every year. We are a rent controlled park and the park does need to be maintained, it doesn't all come through our rent and ELS can't raise rent to fix major issues in the park. We work to ensure ELS charges what is legal and of benefit to the park residents as governed by the 2024 California State Mobilehome Residency Law (MRL) and the City of San Rafael Mobilehome Rent Stablization Ordinance (MRSO). We manage these discussions every year.
MMWD Capital Maintenance Fee Passthrough: ELS began charging for their own MMWD capital maintenance fee back to the residents on 9/1/2023 rent statements. We are seeking counsel on this issue and will report back when there is new status.
New emergency exit access for emergency services: We have been in touch with the deputy fire chief for San Rafael, Robert Sinnott, to work through access through the locked bollards in the new exit near the former fountain at the entrance to the park. We've provided contact / information to ELS and expect to follow up shortly.
Street Lights / pathway lights / sidewalks: We have 1 street light out and the park is aware, they are working through warranty replacement with the vendor and of course will need to schedule installation. We have walked ALL paths in the park (and there are a lot!) and have marked where lights are out and the pathway is in poor shape. We are sharing with ELS and will post an update as soon as we can.
Tree trimming / Park Rules vs. MRL: We have been asked by a resident to investigate who owns responsibility for trees in the park. Park management has indicated trees and shrubs are homeowners' responsibility. We are reviewing the 2024 California State Mobilehome Residency Law (MRL), especially section 798.37.5 sections (a) and (g). We will post an update shortly.
